Proposed Tort reform efforts under way in Congress would hurt citizens

Recently, the House Judiciary Committee approved legislation capping damages in medical malpractice cases. The vote was 18-17. The federal legislation would cover individuals who are insured under Medicare, Medicaid, veterans or military health plans, and the Affordable Care Act, and could also impact people covered under COBRA or health savings plans.

Named as a bill to “improve patient access to health care services” by “reducing the excessive burden the liability system,” the bill slams an artificial cap on awards for pain and suffering at $250,000 in both federal and state cases, among many other things.

Dolan Law is committed to protecting the rights of individuals. This “Bill” would drastically limit the ability to be compensated for injuries caused by the poor care a Doctor or Hospital may have provided a patient. We care about patient safety and the ability to go to court and seek redress.
